By accessing or using the DQMS (Document Quality Management System) platform, you agree to be bound by these Terms of Use. If you do not agree, you must not access or use the platform.
These terms apply to all users of the platform, including registrants, administrators, group leaders, and any other persons granted access.
DQMS provides:
- Digital registration and identity document management
- AI-assisted document quality verification (OCR, blur and glare detection)
- DA Particulares document generation with eIDAS-compliant digital signatures
- Contract generation, signing, and management
- QR code-based document verification
- Group management and bulk processing capabilities
The platform operates under the eIDAS Regulation (EU 910/2014) and eIDAS 2.0 (EU 2024/1183) for electronic trust services, complies with the GDPR (EU 2016/679) for data protection, and aligns with the European Commission's Digital Building Blocks for cross-border interoperability (eSignature, eDelivery, EUDI Wallet).
As a user of the platform, you agree to:
- Provide accurate, complete, and truthful information during registration
- Submit only authentic identity documents that belong to you
- Maintain the confidentiality of your account credentials and magic link access
- Notify us immediately of any unauthorized access to your account
- Use the platform only for its intended lawful purposes
- Not attempt to circumvent security measures, access controls, or rate limits
- Not submit fraudulent, forged, or altered documents
4.1 Digital Signatures
Documents generated through DQMS may be digitally signed using Qualified Trust Service Providers (QTSPs) under the eIDAS Regulation, aligned with the European Commission's eSignature Digital Building Block. Digitally signed documents carry legal validity equivalent to handwritten signatures within the European Union.
4.2 PII Locking
Once a DA Particulares document has been issued or a contract has been generated, the personal information captured in those documents is locked and cannot be modified. This is necessary to maintain the legal integrity of issued documents under GDPR Article 16 and the eIDAS framework. If you require corrections after issuance, contact us to discuss re-issuance options.
4.3 Document Watermarking
Documents generated in non-production environments (development, staging, testing) are automatically watermarked and are NOT legally binding. Only documents generated in the production environment without watermarks carry legal validity.
4.4 RFC 3161 Timestamps
Documents may include RFC 3161 cryptographic timestamps that prove the document existed at a specific point in time. These timestamps are generated by compliant Time Stamping Authorities and serve as evidence of document integrity.
Your use of the platform is also governed by our Privacy Policy, which details how we collect, use, store, and protect your personal data in compliance with GDPR (EU 2016/679).
Key data protection provisions include:
- Right of Access (GDPR Art. 15)
- Right to Rectification (GDPR Art. 16), subject to PII locking after document issuance
- Right to Erasure (GDPR Art. 17)
- Right to Restriction of Processing (GDPR Art. 18) - you may request that document and contract generation be suspended
- Right to Data Portability (GDPR Art. 20)
Data is retained for 7 years for completed registrations and 1 year for rejected applications, in accordance with applicable legal and regulatory requirements.
You agree not to:
- Use the platform for any illegal or fraudulent purpose
- Submit documents belonging to another person without their explicit authorization
- Attempt to gain unauthorized access to administrative functions or other user accounts
- Interfere with the operation of the platform or its underlying infrastructure
- Reverse-engineer, decompile, or extract source code from the platform services
- Use automated tools to scrape, harvest, or collect data from the platform
- Misrepresent your identity or provide false information
Violation of these terms may result in immediate account suspension and may be reported to the appropriate legal authorities.
The DQMS platform, including its design, code, and documentation, is the intellectual property of the platform operator and its licensors. The platform is provided under the MIT License for the open-source components. See our License page for details.
Documents generated through the platform (DA Particulares, contracts) belong to the respective parties involved in the transactions. The platform operator retains no intellectual property rights over user-generated documents.
To the maximum extent permitted by applicable law:
- The platform is provided "as is" and "as available" without warranties of any kind, either express or implied
- We do not warrant that the platform will be uninterrupted, error-free, or free from security vulnerabilities
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the platform
- Our total liability for any claims arising from use of the platform shall not exceed the amount paid by you for the service in the preceding 12 months
Nothing in these terms excludes or limits liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded or limited by applicable law.
These Terms of Use shall be governed by and construed in accordance with the laws of the European Union, including the eIDAS Regulation (EU 910/2014), eIDAS 2.0 (EU 2024/1183), and the GDPR (EU 2016/679), and the applicable national laws of the jurisdiction in which the platform operator is established.
Any disputes arising from or relating to these terms shall be submitted to the competent courts of the platform operator's jurisdiction.
We reserve the right to modify these Terms of Use at any time. Material changes will be communicated through the platform or via email. Your continued use of the platform after changes take effect constitutes acceptance of the revised terms.
Where consent was previously given under an earlier version, we may request renewed consent for material changes that affect your rights or obligations.
